A legal battle over digital privacy has emerged in the United States after the State of Texas filed a lawsuit against Meta Platforms and WhatsApp, alleging that the company misled users about the privacy protections offered by its messaging platform.
The lawsuit, filed by Texas Attorney General Ken Paxton, argues that WhatsApp has long promoted itself as a secure messaging service protected by end-to-end encryption (E2E), leading users to believe that only senders and recipients can access message content.
According to the complaint, these representations created the impression that communications on the platform are fully private and inaccessible to third parties. However, the lawsuit alleges that investigations and insider accounts have raised concerns that certain user communications may have been accessible after messages were sent, contradicting the platform’s public privacy claims.
“Texans deserve to know whether their private communications are indeed truly private,” said Attorney General Paxton. “WhatsApp markets its services as secure and encrypted, but it does not deliver on those promises. I am suing to protect Texans’ privacy and ensure that WhatsApp by Meta does not mislead Texans by unlawfully accessing private conversations and data.”
The case has been brought under the Texas Deceptive Trade Practices Act (DTPA). Texas is seeking a court order that would prevent Meta and WhatsApp from accessing Texans’ WhatsApp messages without consent, along with financial penalties.
The lawsuit is part of a broader series of privacy-related legal actions pursued by the state, including recent cases involving major technology and media companies.
Meta has strongly denied the allegations. Responding to the lawsuit, company spokesperson Andy Stone stated on social media that the claims are false and maintained that WhatsApp cannot access users’ encrypted communications.
The case is expected to intensify ongoing debates around digital privacy, encryption standards, platform transparency, and how technology companies communicate security features to users.
