Mumbai Court Denies Bail to 19-Year-Old Student in ₹3.8 Crore Cyber Fraud Case

A sessions court in Mumbai has denied bail to a 19-year-old Class 12 student, Yash Thakur, who was arrested for allegedly being involved in a cyber fraud case worth ₹3.81 crore. The court highlighted that cybercrimes and digital financial frauds are increasing across the country and pose a serious threat to the national economy.

The case stems from an FIR filed by the CBI against S P Cargo and Courier Services Pvt Ltd, its director Sudhir Palande, and others, stating that several individuals and firms were cheated, and the total sum of ₹3.81 crore was transferred in a single day, July 2, through 12 different transactions into a mule account.

The court, led by special judge J P Darekar, noted, “Cybercrimes, digital financial frauds are rampant in the country and it is a threat to the nation’s economy. It is necessary to consider that the offence is complex in nature and involves use of electronic devices, information and technology that is digital evidence.”

The CBI arrested Thakur on July 9, alleging that he acted as a middleman between various cyber fraudsters and Sudhir Palande, the main accused. According to the investigation, Thakur booked travel and accommodation for Palande in Nagpur during the period of the fraud and also helped him obtain a SIM card using fake documents.

Thakur argued for bail on the grounds that he is a student with no prior knowledge of Palande and claimed there is no evidence of him benefiting from the fraud. His legal team also pointed out his young age and ongoing education.

However, the court rejected these arguments, observing, “The evidence so collected by the prosecution is of digital or electronic nature. The offence involves use of electronic devices and digital means. Yet, the prime accused who is the brain behind the offence has not been traced out. Considering the use of mobile and technology and electronic devices in the commission of the offence, the possibility of absconding, tampering of the evidence and influencing of witnesses cannot be ruled out.”

Just a week earlier, the same court had also rejected bail for another student, 23-year-old Shaurya Singh, who was linked to the same fraud case.
