US begins precautionary revocation of H-1B and H-4 visas amid interview delays

Visa processing disruptions are creating uncertainty for many temporary work visa holders in the United States.

Amid large scale rescheduling of H 1B visa interviews in India, several H 1B and H 4 visa holders based in the United States have reportedly received emails from US consulates stating that their visas have been “prudentially revoked”.

This move comes as the US government expands social media scrutiny for visa applicants, a review process that was earlier limited to international students and has now been extended to H 1B workers and their dependent family members.

A prudential visa revocation is a temporary and precautionary step, not a permanent denial. It does not cancel an individual’s lawful status in the United States but requires the issue to be reviewed again during the next visa interview.

Immigration attorney Emily Neumann said such revocations are increasing even in cases involving past law enforcement interactions that did not result in convictions.

“Many of these incidents were already disclosed and cleared in earlier visa stamps. A revocation does not affect lawful stay in the United States, but it means the issue will be re-examined at the next visa appointment,” she said in a post on X.

She added, “Hard to see how this is an efficient use of government resources when the incident was already previously vetted.”

Neumann also shared an older statement from the US State Department highlighting that visa screening is a continuous process.

According to a Houston based immigration law firm, “A prudential visa revocation is a temporary, precautionary cancellation of a visa by the Department of State (DOS). It is done ‘prudentially’, meaning for prudence or caution, especially in cases where the government suspects there may be an issue with the visa holder’s eligibility but that issue is not yet fully determined.”

Visa holders affected by such revocations can remain in the United States until their status expires. However, if they travel abroad, they will not be able to re enter the country until the visa issue is resolved, even if the visa stamp has not expired.
