US launches Project Firewall, tightening H 1B oversight and raising concerns among Indian professionals

The United States Department of Labor has launched Project Firewall, a new enforcement initiative aimed at strengthening oversight of the H 1B visa programme. The project focuses on cracking down on companies that misuse foreign worker visas by underpaying employees, misrepresenting job roles, failing to report layoffs and bypassing rules designed to protect American workers.

According to the Department of Labor, the initiative is intended to ensure that employers follow regulations strictly and do not use the H 1B system to sideline qualified Americans. The department said, “The ongoing project ensures employers prioritise qualified Americans when hiring and includes enforcement actions to hold employers accountable if they abuse the H 1B visa program.”

The move comes during intense political debate over immigration and jobs. The administration has repeatedly argued that American workers should not be replaced by cheaper foreign labour. Officials say Project Firewall is part of a broader effort to advance the America First labour policy.

Investigators believe some companies have exploited loopholes in the visa system. Initial probes found multiple violations, including false job postings, unpaid wages, incorrect reporting of job locations and failure to report terminations. Authorities discovered cases where H 1B employees were placed on unpaid status between assignments, known as benching, and instances where job ads were created only to show compliance without real intent to hire US workers. The administration said these practices harm both American employees and legitimate foreign professionals by distorting wages and workplace standards.

Senior officials have defended the stricter enforcement approach. The Department of Labor said the effort aims to ensure fair hiring and prevent misuse of the visa programme. The White House press secretary Karoline Leavitt said the goal is not to reject foreign talent but to prioritise domestic workers while recognising the contribution of skilled immigrants. She described the strategy as nuanced.

The impact is significant for Indian nationals, who form the largest group of H 1B visa holders. Experts say stricter enforcement could lead companies to reduce foreign hiring or delay visa sponsorships due to fear of penalties. The heightened compliance requirements may also create uncertainty for current visa holders, affecting renewals, job transitions and long term plans.

Project Firewall signals a notable shift in US immigration enforcement, especially for high skilled visas. While officials say the goal is fairness and protection of American jobs, the policy is expected to influence how companies approach global hiring. Employers will need to prioritise compliance and transparency, while foreign professionals, especially from India, may face closer scrutiny and a more cautious path to building careers in the United States.
