Insurance Claim Rejected Over Google Location Data, Consumer Forum Intervenes

A resident of Silvassa was recently denied a mediclaim reimbursement by an insurance company for a surprising reason. Despite submitting all necessary documents, disclosing pre-existing conditions honestly, and following every policy rule, his claim was rejected because his Google Maps Timeline did not show his presence at the hospital during the dates of treatment.

The case involved Vallabh Motka, who had purchased a mediclaim policy worth Rs 6.52 lakh from Go Digit General Insurance. The policy was valid till February 21, 2025. Motka was admitted to Arham Hospital in Silvassa as an indoor patient from September 11 to 14, 2024, for the treatment of viral pneumonia. He filed a claim of Rs 48,251 for his treatment expenses. However, the company refused to approve the claim, citing discrepancies in hospital bills, case papers, and other documents. They also pointed out that his Google Timeline did not reflect his location at the hospital on the mentioned dates.

After several failed attempts to convince the insurer, Motka approached the Valsad Consumer Disputes Redressal Commission in March 2025. His advocate, A N Desai, presented the treating doctor’s certificate as proof of genuine treatment and stated that all medical care was carried out under proper supervision.

The commission reviewed the case and confirmed that Motka was indeed treated as an indoor patient at the hospital between September 11 and 14. A visit to the hospital and examination of the records further supported his claim. The commission stated, “The investigation report submitted to the court confirmed that Motka was treated as an indoor patient from Sept 11 to 14, 2024 for viral pneumonia. This was further verified by a hospital visit and examination of records. It appears the discrepancy in the Google Timeline was wrongly cited. We are convinced that the insurance company failed to take the doctor’s certificate into account, likely with the intent to reject the claim.”

The forum ordered the company to reimburse the claimed amount of Rs 48,251 along with compensation for mental harassment. Advocate Desai added, “We’ve learned that investigators of some insurance companies mislead patients and gain access to their phones to stealthily review their Google Timeline data. This act is illegal, as they have no authority to check a person’s private details. It’s also possible the patient had their ‘location’ or ‘data’ settings turned off, or faced network issues. Unless Google officials personally verify the data in court, the Timeline holds no legal validity.”
