The District Court of Chandigarh has dismissed the bail plea of an accused in a cyber fraud case worth Rs 1.01 crore, observing that cybercrimes “cannot be equated to ordinary crimes” as they are often carried out by educated individuals skilled in technology. The court further stated that “such syndicate needs to be taken down as a whole.”
The bail application was filed by accused Krishan Shah in connection with an FIR lodged on the complaint of Manjeet, who reported being duped of her savings.
According to the complaint, Manjeet first received a call claiming that a mobile number issued in her name was linked to suspicious activities and money laundering. She was then contacted on WhatsApp by a caller identifying himself as a CBI officer named Sunil. The caller claimed that an ICICI Bank account had been opened in her name and used for illegal activities. He even shared an image of a bank passbook showing her details and a letter bearing “Government of India” stamps.
Under pressure, the complainant was asked to deposit her money in accounts described as “safe custody” for verification. Following his instructions, she transferred approximately Rs 1.01 crore into multiple accounts, only to later discover it was a fraud.
The defence counsel argued that Shah had no direct role in the fraud, only dealt in accounts, and was willing to cooperate with investigators. However, the Public Prosecutor opposed the bail, stating that Shah was linked through co-accused disclosures and was “highly cunning and resourceful,” warning that his release could obstruct the probe and influence witnesses.
Rejecting the plea, the court highlighted the alarming rise in such scams, noting: “Cybercrimes cannot be equated to ordinary crimes under IPC or other penal laws. Such crimes are committed by persons who are educated and well conversant with technology… such a cartel or syndicate needs to be taken down as a whole.”
The court added that custodial interrogation was essential in cases of this nature and granting bail would “send a wrong message to society and boost the morale of culprits who cheat innocent persons.”
